Terms of Service
Please read these terms carefully before using our service.
1. Acceptance of Terms
By accessing or using Passbild-SelberMachen.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
The Service is operated by Christopher Rauser, Mönchhaldenstraße 5a, 70191 Stuttgart, Germany ("Operator", "we", "us", or "our"). These Terms constitute a legally binding agreement between you and the Operator.
2. Description of the Service
Passbild-SelberMachen.com provides an AI-assisted online tool that allows users to create, crop, and format passport and biometric photographs from images they upload or capture via webcam ("User Content"). The resulting images are made available for download for personal use.
The Service is available in two tiers: a free tier in which the generated image carries a watermark, and a paid tier that delivers the image without a watermark and as a print-ready template. We reserve the right to modify the feature set or discontinue the Service at any time, with reasonable advance notice where required by applicable law.
3. Eligibility
The Service is available to users who are at least 16 years of age. If you are under 16, you must have the consent of a parent or legal guardian before using the Service. By using the Service, you represent and warrant that you meet this age requirement or have obtained such consent.
4. Image Processing & Your Data
When you upload or capture an image, it is processed in your browser (client-side) or on our servers solely for the purpose of generating your passport photo. We do not retain, sell, or share your uploaded images or the generated results with third parties.
You retain full ownership of the photographs you upload. By uploading an image, you grant us a limited, temporary, non-exclusive licence to process it for the sole purpose of providing the Service to you. This licence terminates automatically once processing is complete and the image is deleted from our systems.
You are solely responsible for ensuring that you have the right to upload and process any image. You must not upload photographs of other individuals without their explicit consent.
Following a purchase, the generated image is stored in encrypted form on our servers so that you can re-download it at any time within 30 days of purchase. After this 30-day period has elapsed, the image is deleted automatically and permanently. This storage serves this purpose exclusively and is not used for analysis, profiling, training of AI models, or any other secondary purpose.
5. Intellectual Property
All content of the Service (excluding User Content), including but not limited to software, design, text, and graphics, is the property of the Operator or its licensors and is protected by applicable intellectual property laws.
You are granted a limited, personal, non-transferable, non-sublicensable licence to access and use the Service for its intended purpose. No rights are transferred to you other than those explicitly stated herein.
6. Prohibited Use
You agree not to use the Service to:
- Create fraudulent, forged, or otherwise illegal identity documents.
- Upload images of minors without the consent of a parent or legal guardian.
- Upload images that contain nudity, hate speech, or any unlawful content.
- Attempt to reverse-engineer, scrape, or otherwise misuse the Service or its underlying infrastructure.
- Violate any applicable local, national, or international law or regulation.
7. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that photos generated by the Service will be accepted by any government authority, consulate, or other body. It is your responsibility to verify the applicable official requirements for your specific document before submitting any photograph.
8. Limitation of Liability
To the fullest extent permitted by applicable law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Service.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable EU consumer protection law.
9. Consumer Rights (EU)
If you are a consumer resident in the European Union, you are entitled to certain statutory rights that these Terms do not affect, including rights under the EU Consumer Rights Directive (2011/83/EU) and the Digital Content Directive (2019/770/EU).
Because the Service is provided free of charge, and you do not provide personal data as consideration beyond what is strictly necessary for functionality, the right of withdrawal under Article 16 of Directive 2011/83/EU does not apply. However, you remain entitled to all mandatory consumer protections under applicable national law.
The European Commission provides an online dispute resolution (ODR) platform, which is accessible at https://ec.europa.eu/consumers/odr. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board, but we are always willing to resolve disputes amicably by contacting us directly.
10. Privacy & GDPR
The processing of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. As a user in the European Economic Area, your data is processed in accordance with Regulation (EU) 2016/679 (the General Data Protection Regulation, "GDPR").
We process only the minimum personal data necessary to provide the Service. You have the right to access, rectify, erase, restrict processing of, and port your personal data. To exercise these rights, please contact us at contact@formkraft-digital.de.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by displaying a prominent notice on the Service or, where required by law, by other appropriate means, at least 30 days before the changes take effect.
Continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the Service.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules, and applicable EU regulations.
If you are a consumer in the EU, you also benefit from the mandatory consumer protection provisions of the country in which you reside. Nothing in this clause affects your rights as an EU consumer.
For disputes arising out of or in connection with these Terms, the place of jurisdiction is Stuttgart, Germany, to the extent permitted by applicable law.
